Compliance & Enforcement

We have extensive experience with local, state, and federal environmental laws, including rule-making, policy, permits, and enforcement expertise. We have special expertise with Injury and Illness Prevention Plans, and Cal/OSHA requirements.

We believe establishing positive relationships with regulators and developing a reputation for candor is critical both for compliance and enforcement matters. We value the relationships EGC attorneys have built with local, state, and federal regulators, including the decades one of our partners spent serving as counsel for two major California regulatory agencies.

We advise clients on a wide variety of compliance matters including, asbestos and lead-based paint (e.g., operation and maintenance plans, third-party disclosures, statutory notifications, Cal/OSHA requirements); industrial and construction stormwater permits; air permits, water discharges, and disposal of different waste categories, including universal, hazardous, electronic, medical, and special wastes.

We handle a variety of enforcement matters brought by U.S. EPA, the SWRCB, RWQCBs, Cal/OSHA, and local agencies under a broad range of applicable laws. Recent matters include an enforcement action brought by a RWQCB for alleged violations of a construction stormwater permit, and a U.S. EPA action brought under the California Truck & Bus regulations.

The California Department of Toxic Substances Control has been holding workshops over the last year about proposed revisions to DTSC's administrative penalties regulations.
